According to this brochure from Heritage Victoria
(http://www.heritage.vic.gov.au/pages/pdfs/brochures/protecting_arch_sites.pdf):

"All non-aboriginal archaeological sites in Victoria older than 50
years are protected under the Heritage Act 1995, whether or not they
are recorded by Heritage Victoria. For example, if a site is uncovered
in the course of a building project, it is an offence to knowingly
disturb, damage or excavate it without obtaining the appropriate
permission from the Executive Director.

Anyone who excavates or damages an archaeological site without
permission faces penalties under the Heritage Act."

The West Melbourne cable tram line, having opened on 18th April 1890,
would almost certainly fit the criteria.
