Because local councils have no standing under state and federal constitutions, and are purely the creation of state government legislation, they can only do what state governments allow them to do. For the same reason elected counsellors can be sacked and replaced with administrators, councils can be merged or demerged, and the democratically endorsed policies of councils can be overridden by hostile state governments with malicious and unpopular agendas.
In the 1980s the Hawke government proposed a constitutional amendment that would have recognised local governments, but they lost the referendum.
